These terms are an agreement between you and Depart ("we", "us"), the provider of Depart, an AI travel recommendation service. By creating an account or continuing to use Depart, you agree to them. If you are using Depart on behalf of an organisation, you confirm you have authority to bind it; otherwise you confirm you are of legal age to enter this agreement.

The service

Depart generates three personalised trip recommendations based on the travel preferences you provide. Recommendations are suggestions produced with the help of AI models. They may be inaccurate or out of date, and they are not travel, financial, medical, visa or legal advice. Always verify prices, entry requirements and safety information with official sources before booking. You are responsible for your own travel decisions.

Your account

• Provide accurate information and keep it up to date.
• Keep your login credentials confidential; you are responsible for activity on your account.

Acceptable use

You must not:

• use Depart for anything unlawful, fraudulent or abusive, including spam;
• infringe anyone's intellectual property or other rights;
• interfere with the security or integrity of the service — no malware, probing, scraping, or circumventing technical or usage limits;
• reverse engineer, resell or redistribute the service.

Intellectual property

We retain all rights in Depart, including its software, design, branding and content. You receive a limited, non-exclusive, non-transferable right to use the service under your selected plan. You keep ownership of the preferences and content you submit, and grant us a limited licence to host and process it solely to provide the service.

Payments and subscriptions

Depart Pro is offered as a monthly or annual subscription that renews automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms, alongside our own refund policy.

Service level and warranties

We work to keep Depart available and useful, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the twelve months before the claim, and we are not liable for indirect or consequential loss, including lost profits, data or goodwill. Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded by law. You indemnify us against claims arising from your content, unlawful use, or breach of these terms.

Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using Depart at any time. On termination, your access ends and we delete or anonymise your data in line with our Privacy Notice.

General

We may update these terms; material changes will be notified in the app or by email. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.
